Terms of Service

§ 1 Scope
These Terms of Service apply to the use of the TrustCord service (hereinafter "Service"), operated by Arne Werner, Hauptstr. 234B, 26639 Wiesmoor, Germany.
§ 2 Description of Service
TrustCord is a privacy-minimised realness and verification layer for Discord servers. It helps communities protect themselves from bots, AI-generated fakes, impersonators and catfish profiles, and provides verification signals such as liveness status, face-match result, an optional 18+ signal, verification timestamp and expiry. The Service enables server administrators to integrate these checks without processing identity documents themselves. Users complete a verification once and can reuse the resulting signal - with explicit consent - on other servers. Community owners decide how these signals are used for roles, access rules and moderation.
TrustCord is not marketed as a certified national age-verification system and does not guarantee compliance with adult-content access laws, closed-user-group requirements, platform-specific rules, or any specific youth-protection regime. Community owners are responsible for determining whether their use case requires additional legal, youth-protection, access-control or authentication measures.
§ 3 Eligibility and Customer Responsibility
- The Service may only be used by natural persons who have reached the age of 18.
- Server administrators must ensure that use of the Service on their server complies with applicable legal requirements.
- Use for the purpose of circumventing age restrictions or for deception is prohibited.
The Customer is solely responsible for determining the purpose and legal basis for using TrustCord in their community, including any age-gating, role assignment, access control, user notification, consent, and content compliance requirements. TrustCord acts as a technical verification and automation service. Unless expressly agreed otherwise in a separate written agreement, TrustCord does not determine whether a specific community, server, channel, content category, or access model is lawful in the Customer's jurisdiction. TrustCord is not a certified age-verification system for any specific national youth-protection regime and does not guarantee compliance with adult-content access laws, closed-user-group requirements, platform rules, or sector-specific regulations. Customers must obtain their own legal assessment where required.
§ 4 Bring Your Own Key (BYOK)
In BYOK mode, server administrators connect their own third-party API key (e.g. Didit). In this case:
- The administrator is responsible for complying with the terms of service and privacy policies of the chosen third-party provider.
- TrustCord automatically creates a standardised verification workflow in accordance with the TrustCord policy standard (OCR + Passive Liveness + Face Match, minimum age 18 when the age signal is enabled).
- Deviations from the standard workflow are not permitted; TrustCord validates the workflow before each use.
When the Customer connects their own verification provider account, the Customer is responsible for that provider account and its configuration. This includes provider-side data retention, console access, API key permissions, deletion policies, provider terms, user notices, and any required data processing agreements with the provider. TrustCord may attempt to delete provider sessions after processing where technically supported and permitted by the Customer's API key, but TrustCord cannot guarantee provider-side retention settings for Customer-managed provider accounts.
In TrustCord-managed provider mode (where offered), TrustCord configures provider retention to the shortest available retention window and deletes provider sessions after processing where technically supported. TrustCord stores only the privacy-minimised verification result required for the service.
§ 4a Data Minimization
For verification-result processing performed on behalf of the Customer, TrustCord processes only privacy-minimised verification data, such as verification status, liveness result, optional age-threshold result, timestamps, expiry, provider reference, and audit events. TrustCord does not store identity documents, selfies, names, dates of birth, addresses, document numbers, MRZ data, biometric templates, or raw verification provider responses.
§ 5 Subscription and Billing
TrustCord offers a free tier and paid subscription plans (Pro, Enterprise). Paid plans are billed via Stripe. By subscribing, you agree to Stripe's terms of service. Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel at any time; access continues until the end of the paid period.
§ 6 Right of Withdrawal (Consumers)
If you are a consumer (a natural person entering into the contract for purposes outside your trade or self-employed activity), you have a statutory right to withdraw from a paid subscription within 14 days without giving reasons.
Cancellation period: The withdrawal period is 14 days from the day the contract is concluded. To exercise your right of withdrawal, send a clear statement (e.g. by email to arne.werner87@gmail.com) of your decision to withdraw.
Early performance / loss of right: Where the Service is a digital service, you expressly consent to the Service beginning before the end of the withdrawal period and acknowledge that you thereby lose your right of withdrawal once performance has begun in full. For partial performance, you owe a proportionate amount for the service provided up to the point of withdrawal.
§ 7 Data Protection
The processing of personal data takes place in accordance with our Privacy Policy and GDPR requirements. Users can delete all their data at any time using the Discord command /privacy (choose “Delete my data”).
§ 8 Availability and Limitation of Liability
The Service is provided "as-is" in its current development state. No guarantee is given for uninterrupted availability or freedom from errors. Liability for damages arising from unavailability of the Service is limited to cases of intent and gross negligence.
Note: Age verification does not replace a legal age check and does not constitute a guarantee of compliance with youth protection regulations. Responsibility for compliance with legal age restrictions remains with the server operator.
§ 9 Termination
Users may cease using the Service at any time. The command /privacy (choose “Delete my data”) irrevocably deletes all stored data. Server administrators may deactivate the BYOK configuration at any time.
§ 10 Changes to Terms
We reserve the right to amend these Terms. Changes will be published on this page. Continued use of the Service after changes constitutes acceptance.
§ 11 Governing Law and Jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for disputes with merchants is Aurich (Lower Saxony), Germany.
